CLARIFICATION TEXT FOR THE PROTECTION AND PROCESSING OF THE PERSONAL DATA

In this context, we would like to acknowledge you on behalf of our Company about the protection of fundamental rights and freedoms, especially the right of privacy, by considering security of your data with regards to the Law on the Protection of Personal Data No: 6698. We would also like to acknowledge you in terms of purposes and means of collecting and processing your personal data, legal reasons, and your rights.

Your data collected (name, surname, phone number, e-mail address, IP address) will be processed for these personal data processing terms and purposes stated in the articles of Personal Data Protection Law No. 5 and 6; carrying out necessary works by our business units to make you benefit from the products and services offered by our company, registration of identity, address and other information required for the identification of the user, determination and implementation of administrative operations, financial affairs and risk management processes, processing your data in written or electronic form, fulfilling our reporting and informing obligations in accordance with the local and international law and legislations, transferring the important information needed to be shared over your contact information, institutional sustainability and management, strategic planning, information security and informing competent authorities in accordance with the ordinary legislative procedure. 3. To Whom and For What Purposes the Processed Personal Data Can Be Transferred

Your personal data collected could be transferred within the limits of the personal data processing terms and purposes specified in the articles of Personal Data Protection Law No. 8 and 9 and the Policy about the purposes for which your personal data is processed by our Company via web address of http://www.karcan.com/tr/ ; to the authorities of the Institution, third persons, legally authorized public institutions and private persons for the purposes of the execution of the necessary operation manual activities, implementation of participator, registration etc. procedures, giving consultancy services and fulfilment in compliance with the legislations. Technical and legal measures are taken to avoid the violation of rights while transferring data to third parties. Also, your personal data may be transferred and processed to the cloud service providers running our operational activities, which may have servers in various countries.

4. The Method and Legal Reason for Collecting Personal Data

Your personal data is collected and processed within the legal framework for our business operations continuity, any written or oral and electronic media collected for this legal reason can be processed and transferred within the scope of purposes stated in this Clarification Text and personal data processing conditions

5. The Rights of Personal Data Owner as Set Out in Artıcle 11 of LPPD

Without prejudice to the circumstances set forth in article 28 titled “Exceptions” of the Law on Protection of Personal Data, you have the right to apply to our company for the following actions in accordance with your rights within the scope of article 11 of the Law on Protection of Personal Data:

• a) To learn whether or not your personal data have been processed, request information as to processing if your data have been processed, learn the purpose of processing of the personal data and whether data are used in accordance with their purpose.
• b) To get to know about the third parties to whom personal data have been transferred, at home or abroad
• c) To request any incompletely or inaccurately processed data to be corrected
• d) To request deletion or destruction of personal data in the event of processing of personal data is no longer required and the Company has no legal provision or legitimate interest to process your personal data.
• e) To request notification of the operations in the articles (c) and (d) made in this regard to third parties to whom personal data have been transferred
• f) To object to the analysis, exclusively by automatic means, of your personal data, which leads to an unfavorable consequence for the data subject, to request compensation for the damage arising from the unlawful processing of your personal data.

Your rights are effective from 07.10.2016 as per the Law on Protection of Personal Data,

However, if the transaction requires an additional cost, a fee may be charged at the tariff price by the Personal Data Protection Committee and our Company reserves the right to claim the costs in accordance with the Article 13 of the Law on Protection of Personal Data

You may submit your requests regarding your rights mentioned above by written Protection of Personal Data application form (identity authentication or notarization is required for the applications in person) or registered e-mail (KEP), secure e-mail, mobile signature or the e-mail address which is already registered at data controller system.
